Terms of service
These terms of use (hereinafter referred to as the "Terms") determine the conditions for using the online shop (hereinafter referred to as the "Service") provided by Create With Co., Ltd. (hereinafter referred to as the "Company") on this website. Users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.
Article 1 (Application)
These Terms shall apply to all relationships between Users and the Company regarding the use of the Service. The Company may establish various provisions (hereinafter referred to as "Individual Provisions"), such as rules for using the Service, in addition to these Terms. Article 2 (User Registration)
In order to use the Service, the applicant for registration shall agree to these Terms and apply for registration in accordance with the Company's prescribed method. The registration shall be completed when the Company notifies the applicant of its approval. The Company may refuse to approve the application for registration if the applicant falls under any of the following reasons and shall not be obliged to disclose the reason:

- If the applicant has violated these Terms in the past
- If the Company deems the application for registration to be inappropriate for any other reason
Article 3 (Management of User ID and Password)
Users shall be responsible for managing their User ID and password for the Service. Users shall not transfer, lend, or share their User ID and password with any third party under any circumstances. If a combination of User ID and password matches the registered information and is logged in, it shall be deemed to be used by the User who registered the User ID. The Company shall not be liable for any damages arising from the use of the User ID and password by a third party unless the Company has intentional or gross negligence.
Article 4 (Sales contract)
In this Service, a sales contract is established when a User applies to purchase a product from our company and we notify the User of our acceptance of the application. The ownership of the product shall transfer to the User when we deliver it to the shipping carrier. Our company may cancel the sales contract without prior notice to the User if the User falls under any of the following circumstances:
- The User violates this Agreement.
- The product cannot be delivered due to unknown delivery destination or prolonged absence of the recipient.
- Other circumstances in which our trust relationship with the User is considered to be compromised. The payment method, shipping method, cancellation method for purchase, return method, and other matters related to this Service will be determined by our company separately.
Article 5 (Intellectual Property Rights)
The copyrights or other intellectual property rights of the product photos and other contents (hereinafter referred to as "Content") provided by this Service belong to our company, content providers, and other legitimate rights holders. Users shall not reproduce, reprint, modify, or use them for any secondary purposes without permission.
Article 6 (Prohibited Acts)
When using this Service, Users must not engage in the following acts:
- Acts that violate laws or public order and morals.
- Acts related to criminal activities.
- Acts that infringe on copyrights, trademark rights, or other intellectual property rights included in this Service.
- Acts that destroy or interfere with the function of our company's servers or network.
- Acts that commercially use information obtained through this Service.
- Acts that may interfere with the operation of our Service.
- Acts of unauthorized access or attempted unauthorized access.
- Acts of collecting or storing personal information of other Users.
- Acts of impersonating other Users.

Article 7 (Suspension of Service Provision)

Article 8 (Restriction of Use and Cancellation of Registration)

- The User has not used the Service for a certain period of time since the last use of the Service.
- In any other case where the Company deems the use of the Service inappropriate. The Company shall not be liable for any damages incurred by the User as a result of the actions taken by the Company under this Article. Article 9 (Withdrawal) The User may withdraw from this Service by following the prescribed withdrawal procedure.
Article 10 (Disclaimer and Limitation of Liability)
The Company does not guarantee that this Service is free from defects (including but not limited to defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, errors, bugs, and infringement of rights) either in fact or in law. The Company shall not be liable for any damages incurred by the User as a result of using this Service. However, if the contract between the Company and the User regarding this Service (including this Agreement) becomes a consumer contract under the Consumer Contract Act, this disclaimer shall not apply. Even in this case, the Company shall not be liable for any damages incurred by the User as a result of the Company's negligence (excluding gross negligence) or tort, except for damages incurred under special circumstances that were foreseeable by the Company or the User regarding the occurrence of damages. The Company shall not be liable for any transactions, communications, or disputes between the User and other users or third parties regarding this Service.
Article 11 (Changes to the Service Content, etc.)
The Company may change the content of this Service or suspend the provision of this Service without notice to the User, and shall not be liable for any damages incurred by the User as a result. However, the Company will maintain the provision of the Service during the service period at the time of purchase.
Article 12 (Changes to the Terms of Use)
We may change these Terms of Use at any time without notifying the user if we deem it necessary. However, if a user starts using the Service after the changes have been made, the user will be deemed to have agreed to the revised terms and conditions.
Article 13 (Handling of Personal Information)

Article 14 (Notification or Contact)
Notifications or communications between the user and us shall be made in the manner specified by us. Unless the user gives notice of a change in the manner specified by us, we will consider the currently registered contact information to be valid and will send notifications or communications to that contact, which will be deemed to have reached the user upon transmission.
Article 15 (Prohibition of Assignment of Rights and Obligations)
The user may not assign or pledge the status under the Service Agreement or the rights or obligations based on these Terms of Use to a third party without our prior written consent.
Article 16 (Governing Law and Jurisdiction)
The interpretation of these Terms of Use shall be governed by Japanese law. However, regarding the Service, we exclude the application of the United Nations Convention on Contracts for the International Sale of Goods. In the event of a dispute related to the Service, the exclusive jurisdiction and venue shall be the court located in our headquarters.
